Today, attorneys Anne Block and John Scannell (Amici), join attorney Sara Naheedy and engineer Tom Scott, with an amicus brief in support of Scheidler filed with the US 9th Circuit Court of Appeals. Scheidler is suing Washington State, Judge Kevin Hull and legislators Jesse Young, Michelle Caldier and Jan Angel for civil rights violations that stem from Judge Hull’s unlawful order imposing $119,373.23 sanction on Scheidler for his filing a Washington State Bar grievance against Hull’s colleague of the bar, Scott Ellerby. Scheidler notified legislators Jesse Young, Michelle Caldier and Jan Angel, about Hull’s unlawful santion and who take an oath to “protect and maintain individual rights” as Washington’s constitution requires. However, instead of “protecting” Scheidler, his representatives aided and abetted in Hull’s criminal conduct in a quid-pro-quo scheme. See Scheidler’s complaint.
Scheidler’s lawsuit has been dismissed by Federal judges who claim that the State, judges and legislators have absolute immunity from lawsuits. However Scheidler, and now Amici, Block and Scannell, argue that Washington’s contitution prohibits “privileges and immunities” and are asking the US 9th Circuit to comply with Washington’s constitution, reverse their “immunity” ruling, and allow Scheidler’s lawsuit to proceed to a jury.
