Update: Teachers Union — Lawsuits already planned, Complaints filed with WA Attorney General

At present the

Freedom Foundation is looking for parents of current students who would be willing to participate as intervenors if/when the school districts sue to break the teachers’ strike.

We think that if the teachers strike, there are two concrete things that a court could do to serve the best interest of parents and children: (1) authorize the school district to fire striking teachers and replace them with teachers willing to accept the terms the school district is offering, and (2) if the district is incapable of providing classes for its students, the district should pay for the students to attend schools that can meet the students’ educational needs.

Additionally, today I have filed a consumer complaint with the WA State Attorney General (See below), And provided an email to both the SKSD and the SKEA stating the following,

This is fair warning… if the Attorney General refuses to act to protect the rights of homeowners in their good fai(th) business expectancy between the School District and these homeowners, of which I am one, I will, under RCW 7.56, be seeking to remove the SK School Board for breach and for damages against the District… All other rights of action against any other party preserved.

Explanation of complaint:
Background: South Kitsap Homeowners have been paying a South Kitsap School District ‘s [SKSD] levy that was passed by voters. This has created a “business expectancy” between Homeowners who are paying this levy and the School District who receives this levy money.

Cause of Complaint: As the news reports … the South Kitsap Education Association [SKEA] plans on going on ‘Strike’ if the Association’s demands are not met. The is reported by the SKEA on their web site and in local newspapers. If the SKEA by their threatened strike or in any other way ‘interferes’ with the South Kitsap School Districts obligation to homeowners who are paying the District Levy, the SKEA will be interfering with the business expectancy established by the levy between the SKSD and Homeowners who are paying the levy.

Solution requested.

Seek an injunction against the SKEA that will prevent a strike. Or claim for damages, return of levy amount, on behalf of all the homeowners’ who, in good faith, pay a levy tax in exchange for the SKSD providing educational services unencumbered by third parties – i.e. the SKEA.
